These terms apply to https://www.compasspointconsulting.co.za and any page on that site (the “Site”). The Site is operated by CompassPoint Consulting (Pty) Ltd, registration number 2013/112566/07 (“we”, “us”, “our”).

By using the Site you accept these terms. If you do not accept them, do not use the Site. We may update these terms by posting a new version on the Site. Continued use after a change is posted is acceptance of the change.

These terms cover use of the website only. They are not the engagement letter for fractional CFO or other professional services. Those services are agreed separately in writing.

2. Using the Site

Access is provided on a temporary basis. We may change, suspend or withdraw any part of the Site without notice. We are not liable if the Site is unavailable.

You must use the Site lawfully and in line with these terms and our Privacy Policy. You are responsible for anyone who accesses the Site through your connection.

3. No professional advice on the Site

Articles, pages, the “Is a Fractional CFO right for me?” questions and any other material on the Site are general information. They are not accounting, tax, legal or investment advice and must not be relied on as such. A relationship with us only starts when we have agreed an engagement with you in writing.

4. Intellectual property

We own or licence the content on the Site (text, images, logos, layout and code). You may view and print pages for personal or internal business use. You may not copy, sell or commercially reuse the content without our written permission.

5. Contact form and messages

If you send a message through Let’s Talk or by email, you confirm the information is accurate and that you are allowed to send it. We will use it only as described in our Privacy Policy.

6. Acceptable use

You must not:

  • introduce viruses or other harmful code;
  • attempt to gain unauthorised access to the Site or our systems;
  • scrape, harvest or automatically extract data from the Site;
  • use the Site in a way that is unlawful, defamatory or infringes anyone’s rights.

If you breach this section we may block access immediately.

7. Links

To link to the Site, email michael@compasspointconsulting.co.za. Links from the Site to third-party sites are for information only. We do not control those sites and are not responsible for them.

8. Liability

The Site is provided “as is”. To the extent allowed by South African law, we exclude implied warranties and are not liable for loss of profit, revenue, data, goodwill or any indirect or consequential loss arising from use of the Site.

Nothing in these terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under the Consumer Protection Act or other mandatory South African law.

Our total liability arising from use of the Site is limited to the amount you have paid us (if any) to use the Site, which in the ordinary case is nil.

9. Indemnity

You agree to indemnify us against claims, costs and losses arising from your misuse of the Site or your breach of these terms.

10. Privacy

How we collect and use personal information is set out in our Privacy Policy on this Site.

11. Law and disputes

These terms are governed by the law of the Republic of South Africa. The South African courts have jurisdiction, although we may also bring proceedings where you live.
